Medical malpractice occurs when a patient is harmed due to a healthcare provider's failure to meet the accepted standard of care for their profession.  The provider's negligence must cause injury or death.


To have a valid medical malpractice case, you need to prove the following:


  • Negligence:  The healthcare provider failed to meet the standard of care expected in the medical profession of a reasonable and prudent provider under similar circumstances.
  • Causation:  The healthcare provider's negligence directly caused injury or death.
  • Damages:  The value of your damages.
